What is State Question 788?

State Question 788 is a citizen initiative on Oklahoma’s June 26th ballot. A YES vote would legalize the licensed use, sale, cultivation, and possession of marijuana for medical purposes in Oklahoma. The program would be regulated by the Oklahoma State Department of Health and would require a signed recommendation from a licensed Oklahoma physician.
SQ788 is a medical measure. It does not legalize recreational use, and it does not allow anyone to use marijuana in a public place. The language was drawn from medical marijuana laws already working in other states, keeping what has worked and leaving out what has not.

What SQ788 Would Do

  • Let patients with a physician’s recommendation apply for a two year medical license issued by the State Department of Health.
  • Set a state application fee of $100, reduced to $20 for Oklahomans on Medicaid, Medicare, or SoonerCare, and for 100% disabled veterans.
  • Place a 7% tax on retail medical marijuana sales, with revenue directed first to running the program and then to education and the state.
  • License dispensaries, growers, and processors so patients have a safe, tested, and regulated supply.
  • Leave the decision about who benefits to the physician, rather than a fixed government list of qualifying conditions.

Who Can Qualify

Any Oklahoma resident age 18 or older could apply with a recommendation from a board certified physician. Applicants under 18 would need recommendations from two physicians and the consent of a parent or legal guardian. Licenses would be valid for two years and could be renewed.
License holders would be allowed to possess limited amounts of marijuana for personal medical use, including up to three ounces on their person and up to eight ounces kept securely at home, along with a small number of mature plants and seedlings. Why Vote Yes on 788

Oklahomans deserve the freedom to follow their doctor’s advice. SQ788 gives patients a legal, regulated, and taxed option that already works in more than half the country. It keeps the choice between a patient and their physician, offers an alternative to opioids for people living with chronic pain, and brings an existing market into the open where it can be tested and held to a standard.
